Welcome to Phoenix Crafted. These Terms of Service (“Terms”) govern your use of phoenix-crafted.com, the Phoenix Operations Hub at hub.phoenix-crafted.com, your interactions with Phoenix Crafted, and purchases made through our website.

By accessing the website, using an authorized Phoenix Crafted business system, creating an account, submitting a custom-order request, or placing an order, you agree to these Terms and the policies incorporated into them.

Please read these Terms carefully before using the website, using an authorized Phoenix Crafted service, or purchasing a product.

1. About Phoenix Crafted

Phoenix Crafted is an owner-operated North Carolina business offering handcrafted and hand-finished products, including:

• Coconut soy and beeswax candles

• Wax melts

• Tealights and votives

• Decorative candles

• Home-fragrance accessories

• Candle-care products

• Gift sets

• Finished diamond paintings

• Custom solid-wood frames

• Custom and personalized products

The Kernersville location is Phoenix Crafted’s public physical storefront. Visits, pickups, returns, and in-person services are subject to posted business hours and any applicable appointment, pickup, or return instructions.

2. Eligibility

By using this website or placing an order, you represent that:

• You have reached the age of legal majority where you live; or

• You are using the website under the supervision and with the permission of a parent or legal guardian; and

• You have the legal authority to enter into an agreement with Phoenix Crafted.

You may not use the website or purchase products for an unlawful purpose.

Access to internal Phoenix Crafted systems, including the Phoenix Operations Hub, is limited to authorized users.

3. Store Policies

The following Phoenix Crafted policies form part of these Terms:

When a product page, custom quote, promotion, connected-platform authorization, or written agreement contains terms specific to a transaction or service, those specific terms also apply.

If there is a conflict, the more specific term will generally control for that transaction or service unless prohibited by law.

4. Products and Handmade Variations

Many Phoenix Crafted products are made, poured, assembled, finished, packaged, or framed by hand.

Handmade and natural-material variations may include:

• Slight differences in wax color or texture

• Frosting, crystallization, wet spots, or minor surface marks

• Minor differences in fill level or decorative placement

• Slight wick-position variations

• Natural variations in wood grain, knots, stain, or finish

• Small differences in diamond-art placement, texture, or reflection

• Packaging or label-placement variations

• Differences caused by lighting or screen settings

These variations are part of the handcrafted nature of the products and are not necessarily defects.

Product photographs are intended to represent the item accurately, but the product received may not be identical to the photograph.

5. Product Ingredients and Descriptions

Phoenix Crafted makes reasonable efforts to provide accurate product descriptions, ingredients, dimensions, fragrance notes, estimated burn times, and care instructions.

Standard container candles generally use a coconut soy and beeswax blend. Because the blend contains beeswax, those candles are not vegan.

Products may use:

• Lead-free cotton wicks

• Wooden wicks

• Candle-safe fragrance oils

• Essential oils where specifically stated

• Decorative or specialty materials identified in the applicable listing

Phoenix Crafted currently describes its fragrance oils as phthalate-free and paraben-free based on supplier information. Product formulations and suppliers may change, and the applicable product listing should be reviewed before purchase.

Customers with allergies, asthma, fragrance sensitivities, or other health concerns should review available product information and consult an appropriate healthcare professional when necessary.

Phoenix Crafted products are not medical products and are not intended to diagnose, treat, cure, or prevent any medical condition.

6. Fragrance and Product Performance

Fragrance is subjective. Cold throw, hot throw, perceived intensity, and fragrance preference may vary based on:

• Room size

• Ceiling height

• Airflow

• Temperature

• Warmer type

• Candle size

• Wick type

• Burn duration

• Personal scent perception

• Fragrance adaptation

Burn time and fragrance-performance estimates are approximations rather than guarantees.

A personal dislike of a fragrance is not a product defect. Eligible scented products may, however, qualify for the Phoenix Crafted 14-Day Scent Swap Guarantee described below.

7. Candle, Wax Melt, Tealight, and Votive Safety

Customers are responsible for reading and following all product labels, care instructions, and manufacturer instructions for any warmer, holder, accessory, or tool.

General candle-safety requirements include:

• Never leave a burning candle unattended.

• Keep flames and hot wax away from children, pets, drafts, and flammable materials.

• Place candles on stable, level, heat-resistant surfaces.

• Remove loose debris before lighting.

• Trim the wick according to the product-specific instructions.

• Do not exceed the maximum burn-session time stated on the product label.

• Extinguish the candle if the flame becomes unusually high, unstable, smoky, or unsafe.

• Allow wax and vessels to cool before touching, moving, trimming, or relighting.

• Stop use at the minimum remaining-wax level stated on the label.

Wax melts must be used only in warmers designed for scented wax and in accordance with the warmer manufacturer’s instructions.

Votives must be burned in close-fitting, heat-safe votive holders. Tealights must remain in their original heat-safe cups unless the product instructions specifically state otherwise.

Never add water to wax or heat wax directly on a stove, in a microwave, or over an unapproved heating source.

Phoenix Crafted is not responsible for loss or injury caused by misuse, failure to follow warnings, use with an unsuitable accessory, unauthorized product alteration, or continued use after a hazardous condition becomes apparent, except where liability cannot legally be excluded.

8. Orders

An order is an offer to purchase. Phoenix Crafted may accept, reject, limit, or cancel an order when reasonably necessary, including because of:

• Product unavailability

• Inventory errors

• Pricing or listing errors

• Payment failure

• Suspected fraud or unauthorized activity

• Shipping restrictions

• Unsafe or prohibited customization requests

• Material or production limitations

• Resale concerns

• Violations of these Terms

An automated order confirmation acknowledges that the order was received. It does not necessarily mean the order has been finally accepted or shipped.

If Phoenix Crafted cancels a paid order, the applicable amount will be refunded to the original payment method.

9. Pricing, Taxes, and Payment

Unless otherwise stated:

• Prices are listed in U.S. dollars.

• Applicable taxes and shipping charges are calculated at checkout.

• Payment must be authorized before fulfillment or production begins.

• Payment is processed through Shopify Payments or another available third-party payment provider.

• Phoenix Crafted does not receive or store complete payment-card numbers.

Phoenix Crafted may correct pricing, product-description, promotional, or calculation errors before shipment.

When a material pricing error affects an order, Phoenix Crafted may contact the customer for approval of the corrected amount or cancel and refund the order.

10. Promotions and Discount Codes

Promotions, discounts, gifts with purchase, bonus items, and BTGO offers are subject to the terms shown with the applicable offer.

Unless expressly stated:

• Promotions cannot be combined.

• Discounts do not apply retroactively.

• Promotional thresholds are calculated after discounts and before taxes.

• Gift cards may be excluded.

• Clearance, final-sale, custom, or limited-edition products may be excluded.

• Promotional gifts and BTGO bonus items may be final sale.

• Phoenix Crafted may correct misuse, duplication, or technical errors involving a promotion.

Phoenix Crafted may modify or discontinue a promotion before an order is placed. Changes will not ordinarily affect an already accepted order unless the promotion was applied through fraud, technical error, or misuse.

SMS Marketing Program

Phoenix Crafted offers an optional recurring SMS marketing program.

By separately providing your mobile telephone number and affirmatively opting in to receive Phoenix Crafted marketing text messages, you authorize Phoenix Crafted to send recurring promotional SMS or text messages to the mobile number you provided.

Messages may include product launches, restocks, promotions, special offers, early access opportunities, and other Phoenix Crafted marketing communications.

Message frequency varies. Message and data rates may apply.

Your wireless carrier's message and data rates, terms, and conditions may apply to messages sent or received through the SMS program.

Consent to receive marketing text messages is not a condition of purchase.

To stop receiving Phoenix Crafted marketing text messages, reply STOP to a marketing message. Phoenix Crafted may send one final message confirming that your opt-out request has been received or processed. After opting out, you will not receive additional marketing SMS messages at that number unless you subsequently provide a new valid opt-in.

For assistance with the SMS program, reply HELP to a Phoenix Crafted text message.

You are responsible for providing an accurate mobile number and for notifying Phoenix Crafted if you change, deactivate, surrender, or transfer the number associated with your SMS subscription.

Delivery of SMS messages may be affected by your wireless carrier, device, network availability, filtering, or other circumstances outside Phoenix Crafted's reasonable control. Phoenix Crafted does not guarantee that every SMS message will be delivered.

Participation in the SMS program is subject to the Phoenix Crafted Privacy Policy, including the provisions governing mobile information and SMS consent data.

Phoenix Crafted's marketing email program may be delivered through the Phoenix Operations Hub using Amazon Simple Email Service (Amazon SES) and related Amazon Web Services infrastructure.

11. Shipping and Delivery

Processing times, shipping services, delivery estimates, free-shipping qualifications, address requirements, international shipping terms, and lost- or damaged-package procedures are described in the published Shipping Policy.

Delivery dates are estimates unless Phoenix Crafted expressly provides a written guarantee.

Carrier delays, severe weather, customs processing, holidays, incorrect addresses, and events outside Phoenix Crafted’s reasonable control may affect delivery.

Customers are responsible for entering a complete and accurate delivery address.

Phoenix Crafted’s main business address in Greensboro should not be used for an unauthorized return or customer visit.

12. Returns and Refunds

Eligible standard products may be returned under the published Return & Refund Policy.

In general:

• A return request must be made within 14 days of delivery.

• Standard returns must ordinarily be unused, unopened, and in original condition.

• Return authorization is required before an item is mailed or delivered.

• The customer generally pays return shipping for change-of-mind returns.

• Phoenix Crafted covers approved costs associated with damaged, defective, or incorrect items.

• Custom, personalized, made-to-order, opened, used, clearance, and final-sale products may be excluded.

13. Phoenix Crafted 14-Day Scent Swap Guarantee

Eligible candles, wax melts, tealights, and votives may qualify for a scent exchange when the fragrance is not the right fit.

To request a scent swap, the customer must contact Phoenix Crafted within 14 days of confirmed delivery and receive approval before returning the product.

Candles

• No more than one burn

• Vessel, wax, wick, and label remain in good condition

• No heavy use, alteration, contamination, or damage

Wax Melts

• No more than one cube, piece, or portion used

• Remaining product returned in its original packaging

• No mixing with other wax or warmer residue

Tealights and Votives

• No more than one item from the package burned

• Remaining items unused

• Original packaging included

Unless the product was damaged, defective, or incorrect:

• The customer is responsible for return shipping.

• Original shipping charges are not refundable.

• Only one scent swap is available per eligible item.

• Replacement is subject to product and fragrance availability.

• A price adjustment may apply when changing size, vessel, or product format.

The guarantee does not ordinarily apply to:

• Custom or personalized products

• Made-to-order fragrance blends

• Discovery sets and sample sizes

• Clearance or final-sale items

• Substantially used products

• Contaminated or altered products

• Products damaged after delivery

• Purchases made through another retailer

• A replacement product already supplied through a scent swap

14. Custom and Personalized Orders

Custom and personalized products may include custom candles, fragrance blends, labels, gift sets, artwork, and solid-wood frames.

By submitting or approving a custom order, you agree to:

• Provide accurate names, wording, measurements, dates, images, specifications, and delivery requirements.

• Review proofs, quotes, dimensions, colors, and other approval details carefully.

• Obtain permission to use any names, photographs, logos, artwork, or other materials you submit.

• Pay any required deposit or balance according to the quote.

• Acknowledge that production timing may differ from standard processing time.

• Understand that material availability may require an approved substitution.

Phoenix Crafted may decline a custom request that is unsafe, unlawful, technically impractical, infringing, discriminatory, or inconsistent with the business’s capabilities or standards.

Custom, personalized, custom-scent, poured-to-order, and made-to-order items are generally final sale after production begins, except in cases of confirmed damage, defect, or Phoenix Crafted error.

Natural wood grain, knots, stain absorption, and handmade differences are not defects unless they materially depart from the approved specifications.

15. Customer Accounts

You are responsible for safeguarding your customer-account credentials and for activity occurring through your account.

You agree to:

• Provide accurate information

• Keep your contact information current

• Use a secure password

• Notify Phoenix Crafted promptly of suspected unauthorized access

Phoenix Crafted may suspend or terminate an account associated with fraud, abuse, unlawful activity, or violation of these Terms.

16. Phoenix Operations Hub and Connected Services

Phoenix Crafted operates an internal business-management platform known as the Phoenix Operations Hub, available at hub.phoenix-crafted.com.

The Hub may be used by authorized Phoenix Crafted personnel to manage or assist with:

• Ecommerce operations;

• Inventory and product information;

• Customer and rewards operations;

• Marketing activity;

• Reporting and analytics;

• Social-media content;

• Campaign preparation;

• Content scheduling and publishing;

• Connected-platform performance information;

• Business recommendations;

• Internal artificial-intelligence-assisted workflows; and

• Other authorized Phoenix Crafted business functions.

Connected Third-Party Platforms

The Phoenix Operations Hub may connect to authorized third-party services, including:

• Shopify;

• Google;

• Google Merchant Center;

• YouTube;

• Meta platforms, including Facebook and Instagram;

• TikTok;

• Pinterest;

• LinkedIn;

• Email and marketing providers;

• Analytics platforms; and

• Other services approved by Phoenix Crafted.

Use of a connected platform remains subject to that platform’s applicable terms, privacy policies, developer policies, API restrictions, rate limits, authorization requirements, and technical controls.

Phoenix Crafted does not represent that every feature of a connected third-party platform will be available through the Hub.

Authorization and Account Connections

Connected accounts may be accessed only after an authorized user grants the permissions required by the applicable platform.

Authorization may involve:

• OAuth;

• Access tokens;

• Refresh tokens;

• API credentials;

• Platform authorization screens;

• Business-account permissions; or

• Other provider-approved methods.

Users must not connect an account they do not own, administer, or have authority to manage.

Phoenix Crafted does not authorize the Hub to bypass a platform’s authentication, permissions, review requirements, publishing controls, or security restrictions.

Social-Media Publishing

Where permitted by the applicable platform, the Phoenix Operations Hub may allow authorized users to:

• Prepare posts;

• Upload media;

• Create captions or descriptions;

• Schedule content;

• Submit drafts;

• Publish approved content;

• Retrieve publishing status;

• Analyze content performance; and

• Manage other permitted social-media activity.

Some platforms may require the user to complete or approve publishing inside the platform itself.

Availability of direct publishing depends on the permissions and features granted by the applicable platform.

Artificial Intelligence and Recommendations

The Phoenix Operations Hub may use artificial intelligence or automated systems to assist authorized personnel with:

• Drafting content;

• Identifying trends;

• Summarizing business information;

• Detecting anomalies;

• Recommending improvements;

• Preparing proposed actions;

• Organizing workflows; and

• Supporting business analysis.

AI-generated content, findings, recommendations, or proposed actions may contain errors and should be reviewed before reliance or external use.

Phoenix Crafted may require human approval before publishing content, changing third-party systems, communicating externally, or performing other significant actions.

Internal Access

The Phoenix Operations Hub is not a public customer service unless Phoenix Crafted expressly makes a specific portion available to customers.

Unauthorized access is prohibited.

Users may not:

• Attempt to access the Hub without authorization;

• Share credentials or access tokens with unauthorized persons;

• Attempt to obtain another user’s credentials;

• Probe or circumvent security controls;

• Reverse engineer authentication systems;

• Extract protected business information;

• Access connected accounts beyond the permissions granted;

• Use the Hub for unlawful, fraudulent, abusive, or deceptive activity;

• Attempt to bypass third-party platform restrictions; or

• Interfere with the Hub or any connected service.

Phoenix Crafted may suspend, revoke, or restrict access whenever reasonably necessary for security, compliance, operational, or legal reasons.

Audit and Security Records

The Hub may maintain records of authorized operational activity, including:

• User identity;

• Action type;

• Approval information;

• Proposed changes;

• Before-and-after state where available;

• Connected service;

• Date and time;

• Execution status;

• Error information; and

• Other security or audit information reasonably necessary to operate the system.

These records may be retained according to Phoenix Crafted’s Privacy Policy and legitimate security, operational, legal, and audit requirements.

Disconnection and Revocation

Third-party account connections may be disconnected or revoked through Phoenix Crafted systems where available or through the applicable third-party provider.

After authorization is revoked, functions that depend on that connection may stop working.

Certain historical audit or operational records may remain where reasonably necessary for security, compliance, legal, accounting, or legitimate business purposes.

17. Reviews and User-Generated Content

You may submit reviews, photographs, comments, testimonials, or other content where the website permits.

You retain ownership of content you create. By submitting content to Phoenix Crafted or tagging Phoenix Crafted with the apparent intent that the content be shared, you grant Phoenix Crafted a nonexclusive, worldwide, royalty-free license to display, reproduce, adapt for formatting, and share that content in connection with the website, social media, advertising, and promotion of the business.

This license does not transfer ownership of your content.

Phoenix Crafted will make reasonable efforts to provide attribution when appropriate, but attribution is not guaranteed in every format.

You represent that:

• You own the content or have permission to submit it.

• The content is truthful and reflects your genuine experience.

• The content does not infringe another person’s intellectual-property, privacy, publicity, or other rights.

• The content is not defamatory, unlawful, threatening, obscene, discriminatory, fraudulent, or misleading.

• You have permission from identifiable individuals shown in submitted photographs.

Phoenix Crafted may moderate, decline, or remove content where reasonably necessary.

18. Intellectual Property

The website, the Phoenix Operations Hub, and their original content—including Phoenix Crafted branding, logos, photographs, graphics, written copy, page designs, software interfaces, product descriptions, fragrance names, collection names, and original artwork—are owned by Phoenix Crafted or used with permission.

No content may be copied, republished, modified, distributed, scraped, sold, reverse engineered, or used commercially without prior written permission, except as permitted by law.

You may share Phoenix Crafted product pages or publicly posted photographs for personal, noncommercial purposes when you provide appropriate credit and do not imply sponsorship, partnership, or endorsement.

References to @PhoenixCraftedNC should use the correct platform account where available.

19. Acceptable Website and System Use

You may not:

• Use the website or Phoenix Operations Hub for unlawful or fraudulent purposes.

• Interfere with website, Hub, API, or connected-service security or operation.

• Attempt unauthorized access to customer accounts, servers, databases, administrative systems, APIs, or connected third-party accounts.

• Introduce malware, malicious code, or harmful automated activity.

• Scrape product data, pricing, images, customer information, credentials, tokens, or content for unauthorized resale or republication.

• Use bots to place fraudulent orders or manipulate inventory.

• Impersonate Phoenix Crafted or another person.

• Submit false reviews, claims, chargebacks, or support requests.

• Use website content to train, populate, or operate a competing commercial catalog without authorization.

• Circumvent purchase limits, promotional rules, fraud controls, rate limits, API restrictions, permissions, platform-review requirements, or security controls.

• Attempt to retrieve or expose passwords, secret keys, access tokens, refresh tokens, or other protected credentials.

• Use an authorized integration for purposes beyond those permitted by the connected account owner or platform.

Phoenix Crafted may restrict access, cancel orders, suspend accounts, revoke Hub access, disconnect integrations, or take other reasonable action in response to misuse.

20. Third-Party Services and Links

The website and Phoenix Operations Hub may use, connect to, or link to third-party services, including:

• Shopify

• Shopify Payments

• Other payment processors

• USPS or other carriers

• Amazon Web Services, including Amazon SES and messaging services where enabled

• Review applications

• Google services

• Google Merchant Center

• YouTube

• Meta platforms, including Facebook and Instagram

• TikTok

• Pinterest

• LinkedIn

• Hosting and cloud providers

• Analytics providers

• Social-media platforms

Third parties operate under their own terms, privacy practices, authorization requirements, developer rules, and technical restrictions.

Phoenix Crafted is not responsible for the availability, independent content, security, decisions, outages, policy changes, account restrictions, API changes, or practices of third-party services outside its reasonable control.

Third-party services may modify, limit, suspend, or discontinue functionality at any time.

21. Errors and Availability

Phoenix Crafted attempts to keep website and Hub information accurate but does not guarantee that every description, image, price, availability statement, measurement, analytics result, integration status, recommendation, or estimated timeframe will always be error-free.

Phoenix Crafted may correct errors, update information, disable functionality, or cancel an affected order when reasonably necessary.

Website, Hub, API, or connected-service access may occasionally be interrupted because of:

• Maintenance;

• Provider outages;

• Third-party platform changes;

• API changes;

• Authentication failures;

• Security incidents;

• Rate limits;

• Software updates; or

• Events outside Phoenix Crafted’s reasonable control.

22. Disclaimers

Products and services are provided subject to the descriptions, policies, and express commitments published by Phoenix Crafted.

To the fullest extent permitted by law, Phoenix Crafted disclaims warranties that are not expressly stated, including implied warranties of fitness for a particular purpose where such disclaimers are legally permitted.

The Phoenix Operations Hub, connected-platform integrations, analytics, automated recommendations, and AI-assisted features may depend on information or services supplied by third parties.

Phoenix Crafted does not guarantee that:

• A third-party API will remain available;

• A connected platform will approve or maintain a particular permission;

• Scheduled content will always publish successfully;

• External analytics will always be complete or accurate;

• An AI-generated recommendation will be error-free; or

• A third-party platform will accept, display, distribute, or retain content in a particular manner.

However, nothing in these Terms excludes:

• A written promise Phoenix Crafted has expressly made;

• Rights that cannot be waived under applicable consumer-protection law;

• Obligations involving defective or nonconforming products where the law requires a remedy; or

• Liability that cannot legally be excluded.

23. Limitation of Liability

To the fullest extent permitted by law, Phoenix Crafted will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, Phoenix Operations Hub, connected third-party services, or products.

To the fullest extent permitted by law, Phoenix Crafted’s total liability arising from a product purchase will not exceed the amount paid for the product or order giving rise to the claim.

Phoenix Crafted is not responsible for losses resulting solely from an independent third-party platform outage, suspension, API restriction, policy change, or other event outside Phoenix Crafted’s reasonable control.

These limitations do not apply where liability cannot legally be limited, including certain claims involving intentional misconduct, gross negligence, personal injury, or statutory consumer rights.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold Phoenix Crafted harmless from third-party claims, losses, or reasonable expenses resulting from:

• Your unlawful use of the website or an authorized Phoenix Crafted system;

• Your violation of these Terms;

• Materials you submit without proper rights or permissions;

• Your infringement of another person’s rights;

• Your misuse or unauthorized alteration of a product;

• Your unauthorized connection or use of a third-party account; or

• Your attempt to bypass platform, authentication, security, or authorization requirements.

This section does not require you to indemnify Phoenix Crafted for Phoenix Crafted’s own unlawful conduct or negligence where such indemnification is prohibited.

25. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Subject to any consumer rights that permit a claim to be brought elsewhere, disputes arising from these Terms or a purchase will be resolved in a court with proper jurisdiction in Guilford County, North Carolina, or in the applicable federal court.

Before filing a claim, both parties are encouraged to attempt to resolve the issue in good faith by contacting one another.

Nothing in this section prevents either party from pursuing relief in small-claims court when eligible or exercising a right that cannot legally be waived.

26. Severability

If any portion of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

An unenforceable provision will be interpreted or limited only as much as necessary to make it enforceable where permitted.

27. No Waiver

Failure by Phoenix Crafted to enforce a provision of these Terms does not waive the right to enforce it later.

28. Changes to These Terms

Phoenix Crafted may revise these Terms to reflect changes in products, services, connected platforms, business practices, technology, or legal requirements.

The revised Terms will be posted with an updated date.

Changes apply prospectively unless otherwise stated or required by law.

Continued use of the website or applicable services after revised Terms become effective constitutes acceptance of those revised Terms, but material changes will not retroactively alter an already completed transaction where prohibited by law.
